Welcome to Skybound Studios ("we", "us", "our"). These Terms & Conditions govern your access to and use of our website (skyboundstudios.uk) and set out the End-User License Agreement (EULA) for all software, scenery packages, 3D models, textures, and digital assets produced by Skybound Studios.
By downloading, purchasing, or installing any Skybound Studios software or using this website, you agree to be bound by these Terms.
1. Digital End-User License Agreement (EULA)
Unless explicitly covered by a separate, written commercial contract, all software and digital scenery packages purchased or downloaded from Skybound Studios or authorized vendors are granted under a single-user, non-exclusive, non-transferable license strictly for personal, non-commercial entertainment use.
- Permitted Use: You may install and run the scenery on your personal computing hardware for individual flight simulation use.
- Commercial Prohibition: Consumer products purchased through public storefronts must not be used in commercial flight training devices, public exhibits, flight schools, or revenue-generating activities without obtaining a separate commercial license from Skybound Studios.
2. Anti-Piracy, Intellectual Property & Asset Protection
All 3D assets, ground polygon layouts, PBR materials, orthophotos, custom lighting setups, audio files, and code structures remain the exclusive intellectual property of Skybound Studios.
- Strict Anti-Piracy Policy: Unauthorized distribution, sharing, leaking, uploading to torrent networks, or re-hosting of Skybound Studios digital files is strictly prohibited.
- Decompiling & Extraction: You may not reverse-engineer, decompile, extract 3D models/textures, or convert Skybound Studios assets into other simulation platforms or engines without prior express written permission.
- License Termination: Any detected piracy, unauthorized file sharing, or license abuse will result in immediate and permanent revocation of your product license, support access, and account standing, without refund.
3. Real-World Aviation Disclaimer
All consumer scenery products created by Skybound Studios are designed solely for entertainment and home flight simulation purposes. While airfields are constructed with high fidelity, they are not certified for real-world navigation, real-world pilot training, or flight planning. Skybound Studios bears no responsibility for decisions made using our scenery in real-world aviation.
4. Platform Compatibility, Updates & Discretion
Flight simulators (such as X-Plane 12 and Microsoft Flight Simulator) frequently undergo engine updates, SDK changes, and lighting model revisions.
- Maintenance Updates: Skybound Studios endeavours to supply bug fixes, operational patches, and compatibility tweaks free of charge whenever reasonably feasible.
- Major Platform Upgrades: Major software overhauls, core rebuilds, or generational platform transitions (e.g., migrating across major simulator versions or new SDK architectures) may, at our sole discretion, be offered either as paid upgrades or separate releases.
- Compatibility Warranties: Product compatibility is explicitly stated on product store pages. We do not guarantee uninterrupted compatibility with unannounced future simulator builds or third-party operating system updates.
5. Refunds & Digital Product Policy
Due to the intangible nature of downloadable software and digital assets, all sales are final and non-refundable once file access or download links have been issued.
This policy aligns with digital goods regulations under UK Consumer Contracts Regulations, as performance begins immediately upon download. Exceptions are handled strictly at our discretion or in accordance with the specific refund terms enforced by our authorized retail partners (such as Payhip, simMarket, or X-Plane.org).
6. Third-Party Addons, Mods & Limitation of Liability
Skybound Studios products are developed and tested against stock flight simulator installations and explicitly documented dependencies.
- Third-Party Conflicts: Flight simulation environments are complex ecosystems. We are not liable for performance degradation, terrain alignment issues, visual artifacts, or system crashes resulting from conflicts with third-party software, custom mesh addons (e.g., AutoOrtho/Ortho4XP), or unauthorized mod injections.
- Limitation of Liability: To the maximum extent permitted by UK law, Skybound Studios shall not be liable for any indirect, incidental, or consequential damages arising from the installation or use of our software.
7. Authorized Storefronts & Distribution Channels
Official product support, customer service, and version updates are provided exclusively for purchases completed through authorized sales channels (including the Skybound Studios Store powered by Payhip, simMarket, X-Plane.org, and Orbx). Products obtained through unauthorized third-party websites or piracy channels receive zero support and carry no license validity.
8. Governing Law
These Terms & Conditions and any disputes or claims arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales, under the exclusive jurisdiction of the UK courts.
